Untying the Knot - Your Options in Divorce Proceedings

I emphasize alternative dispute resolution (ADR) procedures such as mediation, arbitration, and collaboration. ADR allows you to avoid litigation and puts the key decisions in your own hands. You become an active participant in creating a solution that establishes terms for property division and alimony, and an agreement on child custody and child support. You work at your own pace rather than a court-imposed timeline, and you and your spouse are encouraged to speak freely while crafting a settlement you both can agree on.

These alternatives are less stressful and less costly than litigation, but they only work when both sides are willing to negotiate and work together. If ADR is not right for your case, I will vigorously litigate your case in court.

Experience in High-Asset Division of Property

The size of your estate is not a barrier to amicable resolution. Many of my clients are professionals, business owners, or executives with assets well more than a million dollars, yet I have helped them reach out-of-court settlements on marital property division.

One key to equitable distribution is correct valuation of assets (a professional practice or closely held business, stock options, pensions and retirement funds, real estate), for which I hire experts as necessary. The other sticking point is assets held outside of marriage (separate property) and whether they were commingled during marriage. I work to ensure that community property is properly identified.

Will I Pay Alimony (or Get Alimony)?

Spousal support is not automatically awarded in divorce. At trial, a judge will consider many factors, including income disparity and earning capacity, length of marriage, and accustomed lifestyle. Many couples choose to negotiate spousal support as part of a property agreement, rather than rely on the discretion of a judge. I will advise you on the best recourse for your situation. (Court-ordered alimony can be later modified, but negotiated support payments are non-modifiable).
